Ozona Man Charged with Assault with a Deadly Weapon
Benjamin Hernandez, 23 of Ozona, was arrested Thursday, June 16 for allegedly stabbing another man during a fight in the early morning hours of June 12.
According to the arrest affidavit, a fight broke out at a party on South Plaza Avenue at around 4 a.m. on June 12.
Witnesses reported seeing Hernandez walk up to the victim slowly and wave his right arm in a cutting motion while flicking his wrist across the victim's abdomen.
The victim received a 7 cm wound on the lower left portion of his abdomen near the belly button area that was six inches in length. The wound bled profusely, soaking his shirt, and the lower layers of skin were exposed and hanging out of the wound.
According to the affidavit, witnesses heard people at the party yelling "He stabbed him."
One witnesses said she saw Hernandez take three steps back from the victim as the victim said "I've been cut." That is when she noticed an object in Hernandez' hand. She said Hernandez took off running from the scene.
Hernandez was charged with Aggravated Assault with a Deadly Weapon. That charge is a 2nd Degree Felony that carries with it a punishment of two to 20 years in prison and a fine not to exceed $10,000.
As with all criminal cases, Hernandez is considered innocent until proven guilty by a court of law.
